Registration Requirement - Act 746 and R.S. 15:571.36
Pursuant to Act 746 and R.S. 15:571.36, any person or entity providing electronic monitoring services for individuals under pretrial or post-conviction supervision in Louisiana must register with:

Provider's Certification of Compliance
Providers must certify in writing that they meet the criteria outlined in R.S. 15:571.36.
Prohibition of Unregistered Providers
No person or entity may offer or deploy electronic monitoring services in the State of Louisiana without first completing this registration process.
Enforcement and Removal - R.S. 15:571.36 (D)
If a provider violates the requirements under R.S. 15:571.36, both the Court and the Sheriff may remove the provider from the official registry.
Conflict of Interest Restrictions - Act 746
Elected officials or immediate family members are prohibited from being electronic monitoring vendors or hold a financial interest in the electronic monitoring service providers.
Vendor Neutrality and Compliance - Act 746
The Court shall not recommend or endorse any specific electronic monitoring service providers. However, when issuing an order for electronic monitoring, the Court will verify that the vendor selected by the defendant, counsel or other authorized party is properly registered and in compliance with all requirements of Louisiana Legislative Act 746 and any related statutory provisions.
Method of Reporting Non-Compliance - R.S. 15:571.35 (C) (4)
Electronic monitoring providers shall notify the Court, in writing, of the method by which substantive incidents and/or violations will be reported. The method must ensure the timely, secure and reliable transmission of information consistent with the requirements in R.S. 15:571.36 (C) (4). Acceptable methods may include secure electronic portals, email or dedicated telephone numbers.
Providers remain responsible for ensuring that the method selected is functional, accessible at all required times, and capable of documenting both the transmission and receipt of the report.
R. S. 15:571.36 (D) mandates that the electronic monitoring company, upon receiving notice of a defendant's substantive incident and/or any violations of the electronic monitoring requirements, submit a violation report to the following parties in writing concerning the incident/violation:

By the 10th of each month, providers shall provide to the Court with a detailed compliance report of all individuals being served. The report shall contain:

Grounds for Removal
A provider may be removed from the Court’s registry if they fail to comply with Louisiana Act 746 and/or with Court-imposed requirements, including but not limited to:

- The bail agent of record.
- The law enforcement agencies within the appropriate jurisdiction.
- The prosecuting attorney.
- The Court exercising jurisdiction over the defendant.

By the 10th of each month, providers shall provide to the Court with a detailed compliance report of all individuals being served. The report shall contain:
- Full name and any known aliases of the monitored individual,
- Date of birth, and
- Criminal District Court case number, section, charge and judge ordering monitoring.
Annual Providers Summary Reports - R.S. 15:571.35 (C) (3)
By January 15th, providers shall submit to the Court an annual comprehensive report. This report shall include a detail account of:
- Types of electronic monitoring services provided,
- Listing of parishes served by the provider’s services,
- Total number of individuals who are being monitored during the reporting period,
- Total number of monitoring terminations,
- Reasons for terminations (e.g., completion of sentence, violations, etc.), and
- Credentials and qualifications of the staff members who oversees the electronic monitoring operations.

A provider may be removed from the Court’s registry if they fail to comply with Louisiana Act 746 and/or with Court-imposed requirements, including but not limited to:
- Failure to report incidents or violations in a timely or accurate manner,
- Use of non-compliant or unauthorized monitoring equipment,
- Failure to maintain required records or provide access for audit/review,
- Repeated communication failures with the Court and/or Sheriff, and/or
- Any conduct that jeopardizes public safety, the integrity of Court orders or compliance with statutory law.
